(1) A person seeking authority to depart from any provision of these by-laws in respect of a particular building, site or housing project shall submit a written application, together with the prescribed fee, to the local authority.

(2) When submitting an application in terms of subsection(1), the applicant shall-

a) specify-

i) the provisions of these by-laws from which authority to depart is sough; and

ii) the nature of the departure for which such authority is sought; and

iii) the reason for seeking such authority; and

iv) details as to the building, site or housing project in respect of which the application is made, including, if it relates to a housing projects, details as to the number of dwelling-houses or units comprising such housing project; and

b) provide technical and other information and other evidence in support of the application.

(3) An applicant shall submit such plans, documents or additional information or evidence as the local authority may require.
