(1) Upon receipt of an application in terms of section 60, and subject to any condition imposed or instruction issued in terms of subsection(2) of section 64, the local authority may-

a) refuse to authorize the departure sought, which refusal shall be final; or

b) subject to any conditions or prohibition imposed by the Minister in terms of subsection(2) of section 64, and on the recommendation of a person who-

i) holds professional qualification in the field to which the subject-matter of the application relates; and

ii) is an employee of the local authority, or, where the local authority to which the application is made does not have a suitably qualified person in its employ, of some other local authority;

authorize, subject to such conditions, or, where the local authority may deem expedient, the departure sought in respect of such building, site or housing project:

Provided that the local authority shall not grant any further authorization of the same, or substantially the same, departure unless-

a) the Minister has confirmed the previous authorization in terms of paragraph(a) of subsection (1) of section 63; or

b) such authorization has been permitted by the Minister in terms of subsection(2) of section 64;or

c) recommend to the Minister that-

i) the departure sought by the applicant be authorized, notwithstanding that his has not been recommended as required by paragraph(b); or

ii) some other allied departure be authorized

(2) The local authority shall consider an application as expeditiously as possible, and shall-

a) where the application has been refused or referred to the Minister, as the case may be, advise the applicant of the fact;

b) where it authorizes any departure, issue a departure certificate, specifying-

i) the provisions of these by-laws from which is authorized; and

ii) the nature of the departure which is authorized; and

iii) the building, site or housing project in respect of which the departure is authorized; and

iv) any terms or conditions subject to which the departure is authorized;

c) submit to the Minister-

i) notice of any departure authorized in terms of paragraph (b) of subsection(1);

ii) any recommendations made by the local authority in terms of paragraph (c) of subsection (1).
